Decisions are comparable to judgements

A decision is comparable to a judgement. Receiving the decision of an injunction to pay implies that a payment demand has been established and you must pay or perform the action or actions specified in the decision.

What should you do?

You should then proceed as follows:

  • contact the person to whom you owe money or their representative, if any, to find out how much you are to pay and to what account
  • pay the amount immediately to the person to whom you owe money or to their representative
  • if you cannot pay the entire debt, establish whether or not you may pay off the debt in accordance with an instalment plan
  • if you must perform some action, perform the action stipulated in the decision

Usually, the person who wants to be paid – that is, the person to whom you owe money – will have asked for interest. The interest is stipulated in the decision and the debt will then grow until it has been paid.

What happens if we are to collect the debt?

If the person to whom you owe money wants our help to collect the debt (application for enforcement) you must pay the debt to us. You will then receive a ‘Debt to Pay’ letter, specifying a last date for debt payment. If you have not paid the debt by that date we will investigate whether we can distrain your assets.
