We can help you establish that a tenant is to be evicted.
The most common reason for a tenant’s eviction is unpaid rent. Other reasons include disturbing the neighbours, subletting the flat without the landlord’s approval, or conducting criminal activities in the flat.
Use the form for payment injunctions/ordinary enforcement assistance. Make sure you fill in all the personal data. The claim and the grounds for the claim have to be stated clearly enough that the tenant can understand what the claim is for. For example: “The tenancy right is forfeited due to unpaid rent for the period 1 December 2017 – 29 February 2018, with a payment deadline on XX.”
If the application concerns a person or a family you have to include proof that the social welfare committee has been contacted. If you have informed the tenant about the possibility of recovering the tenancy right despite not having paid the rent on time, you have to include proof of this as well.
When you apply for eviction you have to state whether you want our help in executing the eviction. If you don’t want the eviction to take place straight away you can always use the verdict at a later date, and apply for execution then.
Applying for eviction costs SEK 300. You can also include costs for your own or your representative’s work, usually SEK 420. You pay SEK 600 for us to execute the eviction. You can request compensation for these costs in your application.
If the reason for the eviction is unpaid rent, we check that the tenant has been informed of the possibility of recovering the tenancy right despite not having paid the rent on time. If you have not attached proof that you have provided this information, we will inform the tenant.
We will send a letter about the claim to the tenant in which there is an acknowledgment of service (receipt) that the tenant has to sign and return to us. Once the acknowledgement is signed the tenant has a certain period of time in which to act – the letter will specify how long this period is.
The tenant can act in any of the following ways:
Once you have a verdict for eviction we can execute it. For this we will charge a fee of SEK 600. We always try to charge the fee to the tenant, but if that isn’t possible you will receive an invoice. You may also have to pay additional costs, such as for transport. If you don’t want us to execute the verdict you have to state this in your application.
